Juni 2011 – ein ganz besonderer Tag für
uns… Wir feiern den 12. Geburtstag unseres
„Sonnenscheins“ Anti! Allen Operationen der letzten
6 Jahre zum Trotz, ist er immer noch ein
„lächelnder“ Hund. Mittlerweile nicht nur
lahm sondern auch taub, genießt er sein Seniorenleben. Umso
langsamer (wenn überhaupt) Anti in der Ausführung
unserer Wünsche geworden ist, um so schneller sind wir in der
Ausführung seiner Wünsche geworden. Wir hoffen
inständig, dass er unser Leben noch lange
bereichert… |

June - a very special day for us…. We celebrate the 12th
birthday of our “sunshine” Anti! In defiance of all
surgeries within the last 6 years, he is still a
“smiling” dog. In the meanwhile he not only lame
but also deaf, he enjoys his retirement age. As slow (if anyway) Anti
became in the execution of our wishes, as fast we became in the
execution of his wishes. We devoutly hope that he enrich our live still
a long time…. |

Der
1. Juni 2011, kein guter Tag für uns. Yankee verletzt sich auf
einem Spaziergang und durchtrennt sich die Sehne eines Zehs. Dank Herrn
Dr. Selzer konnte er sofort chirurgisch behandelt werden. Da der
Sehnenriss unterhalb des Ballens lag, gestaltete sich die Operation
nicht ganz so einfach wie geplant. Für Yankee heißt
das nun erstmal vier Wochen Gips und danach noch mindestens zwei Wochen
Verband mit Leinenzwang. Nicht lustig, aber für eine gute
Heilung nicht zu ändern. |

June, no good day for us. Yankee injures on a walk and cut through a
sinew of a toe. Thanks to Dr. Selzer he could treated surgically
immediately. Because the cut of the sinew was underneath the pad, the
surgery wasn’t so simple like planned. For Yankee it means
cast for four weeks and afterwards min. two weeks bandage and
constrained by the lead. Not funny, but not to change for a good
healing. |

Anti,
everybody’s darling…
Unsere Klage gegen Frau Dr. Susanne Wisniewski und Herrn Dr. Kai Morich
bezüglich der fehlerhaften TPLO Operation bei Anti, wurde vom
Gericht abgewiesen.
Obwohl unstrittig, dass bei der Operation der meniscal release nur
unvollständig durchtrennt wurde und laut Herrn Dr.
Höhner dadurch die Knorpelschäden entstanden sind,
war es für das Gericht nicht Beweislast genug. Laut
Gutachterin (welche übrigens von der Gegenseite vorgeschlagen
und vom Gericht angenommen wurde) war zum damaligen Zeitpunkt nicht
bekannt, dass eine nach Slocum abweichende Vorgehensweise sinnvoller
ist. Spannend, dass es offensichtlich nur Einigen nicht bekannt
war… Es ist auch befremdend, dass einer medizinischen
Koryphäe wie Herrn Dr. Höhner, der operativ sichtig
im Kniegelenk war, Fotos gemacht hat und Knorpelteile entfernt hat,
weniger Bedeutung zugemessen wird, als einem von der Gegenseite
vorgeschlagenen Gutachter, der sich sein Urteil am Schreibtisch bildet.
Interessant ist in diesem Zusammenhang auch, dass bei einem sogenannten
„Dienstvertrag“ (zwischen Tierarzt und Halter) ein
Erfolg der Behandlung grundsätzlich nicht geschuldet
ist…
Fakt ist, dass man trotz Klageabweisung nicht zwangsläufig von
der „Unschuld“ der Beklagten ausgehen kann/muss.
Die Beweislast bei Kunstfehlern zu erbringen, ist ein Zauberwerk. Leider
hat sich das Gericht bezüglich
seiner Entscheidung
ausschließlich am Gutachten der von der Gegenseite
vorgeschlagenen Sachverständigen orientiert. Fakt ist auch,
dass Anti (im Gegensatz zu vielen anderen TPLO operierten Hunden) seit
der Operation in der Kleintierklinik Wisniewski nie wieder gut laufen
konnte und viele weitere Eingriffe folgten. Es gibt nichts was ich mehr
bereue, als die Entscheidung Anti dort operieren zu lassen.
Bevor nun wieder eine – wie schon in der Vergangenheit -
wiederholt nicht haltbare Unterlassungsaufforderung kommt…
dieser Text ist natürlich rechtlich abgesichert freigegeben. |

everybody’s darling….
Our lawsuit against Dr. Susanne Wisniewski and Dr. Kai Morick because
of faulty TPLO surgery was denied by the court.
Although indisputable, that during surgery the meniscal release was
only incomplete cut trough and following Dr. Höhner thereby
the cartilage damages arises, it was not enough burden of proof for the
court. Following the surveyor (by the way proposed by the opposing
party and accepted by the court) it wasn’t known that time,
that a procedure deviating from Slocum makes more sense. Exciting, that
only a few didn’t know that…. Also strange, that a
medical luminary like Dr. Höhner, who was surgical-sighted in
the knee joint, who made photos and removed parts of the cartilage, are
measured out minor meaning than a surveyor proposed by the opposing
party, who made his judgment at the desk.
Also exciting in this context, that with a so called “service
contract” (between vet and dog owner) a success of the
treatment is not owed under the contract.
Fact is, that despite the dismissal the “innocence”
of the defendant isn’t assumed necessarily. To adduce the
burden of proof for medical malpractice is a sorcery. Unfortunately the
court orientated concerning his decision only on the survey from the
surveyor proposed from the opposite party.
Fact is
also that Anti (as opposed to many other dogs be operated by TPLO)
never could run or walk in a good way since the surgery in the animal
clinic Wisniewski and another interventions must be done. There is
nothing I regret more than the decision to operate Anti there.
Before now and once again - like in the past - not sustainable desist
warnings will come…. Of course this text is legal secured
approved. |
